Proposed Federal Motorcycle Helmet Law - is Socialism
This isn't Canada yet. A Federal Helmet law should be unconstitutional.
What so many fail to understand (including many current and former judges in our country) is that most Federal laws are unconstitutional. The U.S. Constitution give the Federal Government enumerated and restricted powers. The remaining powers are left up the the individual states.
Ever since the 1930's our courts have been packed with judges that ignore the Constitution and have been usurping State power with activist judicial rulings that favor creating and upholding Federal laws therefore creating Federal law via judicial ruling from the bench. Since these judicial laws did not go through Congress and get signed into law or ratified by the States they are technically ALL unconstitutional.
So, why do these judicial laws still exist
and are still considered valid? Simple. America has not had true Conservative rule since before the 60's. Reagan was great, but the Congress was controlled by the Liberals. Since then we've only had one short period were we had Conservatives willing to take a stand against these laws. Then they caved. President George W. Bush is no Conservative by a long shot, but he does believe in the founding fathers views of the Constitution and has made two great Supreme Court appointments. The Supreme Court is just now starting to reverse some of these rulings and to rule against other cases that would push America further into Socialism. We have a long way to go and many years of bad Judicial rulings to resolve.
This is why a Federal law requiring helmets is wrong. Like I said, this is America not Canada. Our Constitution is better and worth preserving, protecting and restoring.
Also, we still have a few basic truths in this country:
1. With Freedom comes Responsibility. Even though most forget this fact.
2. My Freedom and Liberties end only when they can be proven harm someone else. Many would claim that freedom and liberty should be doled out by the all-knowing Government.
3. Government is an evil necessity, but it should be limited in power and reach.
4. A fine is a tax for doing wrong. A tax is a fine for doing well.

WHAT??!!! Bush has trashed the Bill of Rights to the point where the founding fathers are rolling in their graves. He should be impeached for breaking any one of five different laws and the entire Congress should be impeached for letting him get away with it!
